How to Know if You are Carrying Your Firearm Legally – As Seen on WEAU

LAKE HALLIE, Wis. (WEAU) — It’s been almost seven years since Wisconsin implemented concealed carry laws, and although it has been around for a while, some people may be confused on what is and is not legal while carrying a weapon.

The Department of Justice says an individual must receive proper training before obtaining a permit.

Open carry and concealed carry are both legal In Wisconsin, but they are both different. You do not need a permit to open carry, but a permit is required when carrying a concealed weapon.

“There can’t be any clothing draping over it,” says Dan Marcon, owner of Marc-On Shooting. “If your shirt drops over it just a little bit, that’s considered conceal carry.”

According to the Department of Justice, whenever a person is carrying a concealed weapon, the licensee should have with them their concealed weapon license and their driver license or identification card. Both the license and identification shall be displayed to a law enforcement officer upon request.

If you do not have a permit, when driving in your vehicle, the law requires your weapon to be in plain sight or unloaded, locked and out of arms reach.

Marcon says plain sight is on the dash of your vehicle. He says to err on the side of caution, the gun should be unloaded while on the dash.

If you do have a concealed carry permit, you may carry or keep your weapon fully loaded where ever you’d like. This can be concealed on your hip, in the glove compartment or in your purse, etc.

“You can walk around the streets, a store with a firearm on your hip, however once you get into a vehicle, that is now breaking the law if you do not have a conceal carry license,” says Marcon. “Before you get back in your vehicle, I advise you to take the gun off, unload it, put it in a case and secure the firearm.”

Marcon says having a concealed carry license is important because it helps an individual to know the law, can help you out in court if you ever have to defend yourself, and carrying a concealed weapon does not make you an easy target for crime.

With your driver’s license and your conceal carry license, you can carry concealed wherever the law allows you to.
